Can your super fund still borrow to buy property? It is the question Australian trustees ask most often, and the honest answer in late 2026 is: only in a much narrower set of cases than a year ago.

An SMSF loan is a borrowing arrangement a self-managed super fund uses to buy an asset it could not pay for in cash, and the law that governs it changed on 10 August 2026. This guide separates what is still true from what is now out of date, walks through the process a trustee faces, and ends with a checklist to work through before you talk to anyone.

Spotto Finance arranges finance and does not provide investment, tax or legal advice. Borrowing inside a super fund sits across credit law, super law and tax law at once, so this article is general information only. Consult a licensed financial adviser, your accountant and your lawyer before acting on any of it.

What Is an SMSF Loan and Why Did the Rules Change?

Super law bans a fund from borrowing as a general rule. A limited recourse borrowing arrangement (LRBA) is one of the narrow exceptions, and every SMSF loan written in Australia has used it.

  • The fund borrows to buy a single acquirable asset, most often one property.
  • The asset is held in a separate holding trust, not directly by the fund.
  • The fund holds the beneficial interest and the right to take legal ownership once the loan is repaid.
  • The lender's recourse is limited to that asset, so the fund's other assets are protected if the loan defaults.
  • The ATO explains that a discretionary trust cannot be used as the holding trust.

That structure survives. What changed is the kind of property it may be used to buy.

What Changed for SMSF Borrowing on 10 August 2026?

The Treasury Laws Amendment (Tax Reform No. 1) Act 2026 narrowed the meaning of an acquirable asset. New SMSF borrowing for any real property that is not business real property (which includes residential property) is over; borrowing for qualifying business premises is not.

  • New arrangements entered into on or after 10 August 2026 may only acquire real property that meets the definition of business real property.
  • Arrangements that existed before that date are not affected, and neither is refinancing one of them.
  • The identity of the lender makes no difference, so a bank, a non-bank and a related-party loan are all treated the same way.
  • Business real property generally means land and buildings used wholly and exclusively in a business.

SMSF Loans: Myth Versus Fact

Most of what circulates online about super fund borrowing was written before August 2026, and some of it was wrong even then. These are the five claims trustees repeat most.

Myth Fact
My fund can still borrow for a rental house New LRBAs over property that is not business real property ended 10 Aug 2026
I can live in the property the fund buys It must meet the sole purpose test
My fund can buy a home from my parents It cannot be acquired from a related party
One loan can cover a small portfolio An LRBA funds a single acquirable asset
A property spruiker can advise on this Advice requires an AFS licence or authorisation

ASIC's Moneysmart is blunt on the last point: anyone who gives advice on an SMSF must hold an Australian financial services licence or be authorised by an AFS licensee, and referral fees can create conflicts of interest that influence the advice you are given.

How Does an SMSF Property Loan Work Step by Step?

The mechanics of an SMSF property loan have not changed, only the asset it can be used for. The sequence below is the order a compliant arrangement is usually built in, and skipping a step is where trustees get into trouble.

  1. Confirm with your adviser and accountant that borrowing suits the fund's investment strategy.
  2. Check that the property meets the business real property definition, in writing, before you sign anything.
  3. Establish the holding trust and its trustee, with documents a lender and the ATO will accept.
  4. Apply for finance and have the lender's solicitors review the structure and the contract.
  5. Exchange contracts in the correct name, which is the single most common point of failure.
  6. Settle, then administer the loan, the lease and the fund's reporting for the life of the arrangement.

What Do Lenders Look At in an SMSF Borrowing Application?

SMSF borrowing is assessed on the fund, not on you personally, even though members usually give guarantees. Lenders in this space are specialists and their credit rules are stricter than a standard home loan.

  • The fund's liquidity after settlement, so repayments and expenses survive a vacancy.
  • Contributions and rent as servicing income, tested against the fund's own obligations.
  • The trust deed and investment strategy, which must actually permit the borrowing.
  • The quality and lease profile of the premises being bought.
  • Clean, current fund financials and compliant audits.

In our experience the deals that fall over are rarely refused on servicing; they are refused on paperwork, usually a deed that does not allow borrowing or a contract signed in the wrong name. Fixing either after exchange is expensive and sometimes impossible.

What Does an SMSF Home Loan Actually Cost a Fund?

An SMSF home loan has always been dearer than a standard mortgage, and the costs do not stop at the interest rate. Moneysmart warns that these costs come out of your super and reduce your overall balance.

  • Higher interest rates and fees than comparable non-SMSF lending.
  • Set-up costs for the holding trust and the legal review the lender requires.
  • Ongoing audit, administration and compliance costs for the arrangement.
  • Tax losses that cannot be offset against income outside the fund.
  • Limited flexibility, because the character of the property cannot be changed until the loan is repaid.

What Are Your Options Without a Self Managed Super Fund Loan?

If your plan relied on a self managed super fund loan for any real property that is not business real property (which includes residential property), that path is closed to new arrangements, and the alternatives are not interchangeable with it. Each one has its own tax and compliance consequences that only a licensed adviser can weigh for your fund.

  • Buying residential property outright with the fund's own cash, with no borrowing at all.
  • Keeping and refinancing an existing LRBA that was in place before 10 August 2026.
  • Borrowing for genuine business premises, including your own trading business's property.
  • Investing in property outside super in your own name, where ordinary investment property finance applies and the rules are far simpler.

That last option is where most of the conversations now land. Spotto Finance compares 30+ lenders across the standard home, investment, construction and commercial loan solutions a borrower holds in their own name, and our calculators will show you what that looks like before you commit. What we do not do is advise on whether your super fund should own property; that decision belongs with a licensed financial adviser, your accountant and your lawyer.

Your SMSF Property Finance Checklist

Work through this before you make an offer, not after. Every item is something a lender, an auditor or the ATO will eventually ask about.

  • Written confirmation from a licensed adviser that borrowing fits the fund's strategy.
  • Legal advice that the property meets the business real property test today and will for the life of the loan.
  • A trust deed that expressly permits the fund to borrow under an LRBA.
  • A holding trust established, and a clear note of the exact name the contract must be signed in.
  • Proof the asset is not being acquired from a related party, and will not be used by one.
  • A liquidity buffer that covers repayments, rates, insurance and a vacancy.
  • Sole purpose test compliance checked against the ATO's guidance, which the ATO says is breached by arrangements such as buying a rental property so a related party can live in it.
  • Your accountant's estimate of the set-up, audit and administration costs the fund will carry.

Frequently asked questions

Can an SMSF still borrow to buy a residential investment property?

No. Under the Treasury Laws Amendment (Tax Reform No. 1) Act 2026, a limited recourse borrowing arrangement entered into on or after 10 August 2026 can only acquire real property that meets the business real property definition. Arrangements that existed before that date are not affected.

What happens to an SMSF loan my fund already has?

The ATO states that the change does not impact arrangements existing prior to 10 August 2026, and does not impact the refinancing of those arrangements. Your existing loan can continue and can be refinanced, but confirm the position with your adviser and the fund's auditor before you change anything.

What counts as business real property?

It generally means land and buildings used wholly and exclusively in a business. Whether a particular property qualifies is a legal question about how the property is actually used, so get written advice on it before you sign a contract rather than after.

Can I live in or rent a property my super fund owns?

No. The property must meet the sole purpose test of providing retirement benefits, it cannot be acquired from a related party of a member, and it cannot be lived in or rented by a member or a related party. The ATO gives buying a rental property so a related party can live in it as an example of a breach.

Why is an SMSF home loan more expensive than a normal mortgage?

ASIC's Moneysmart notes that SMSF property loans often have higher interest rates and fees than other loans, and that the arrangement carries upfront and ongoing costs that come out of your super and reduce your balance. The holding trust, legal review, audit and administration all add to the total.

Does Spotto Finance arrange SMSF loans?

Spotto Finance arranges home, investment, construction, business and commercial finance across 30+ lenders, and does not provide investment, tax or legal advice. If you are weighing up property inside a super fund, that decision needs a licensed financial adviser, your accountant and your lawyer first.

Who is allowed to advise me on SMSF borrowing?

ASIC's Moneysmart says anyone who gives advice on an SMSF must hold an Australian financial services licence or be authorised by an AFS licensee, and that property developers must hold a licence if they provide financial advice. Be careful of referral fees, which Moneysmart warns can create conflicts of interest.
